‘False Self-Employment’ in the Construction Industry
Huge controversy has been caused by the government’s issuing of a consultation document which is very provocatively called “False self-employment in construction”. At the heart of it is the view that there are too many people in the industry who are self-employed under current law. So the government would like to change the law! Under the proposal workers in the construction industry would be self-employed only if they met one of three tests. Result – lots more NIC and PAYE for the government. And this is likely to be the thin end of the wedge: if HMRC steal self-employed status from construction industries as they propose, can it be long before they extend similar rules to other industries? Understandably, there has been an outcry unequalled since the introduction of the “IR35” regime and the proposals have been pretty well universally condemned.
