Many of the issues that relate to UK property investors apply also to overseas property investors. But overseas investors still enjoy some exemptions from UK capital gains and inheritance taxes. These have been curtailed in recent years, particularly for residential property, but some still remain. The exemptions are now complicated: to secure these, your investment has to be structured carefully.
Special (unfavourable) rules apply where you are buying an “expensive property” to use as your home. Expensive is now more than £500,000, so these rules apply to relatively modest properties.
Historically, it has generally been beneficial for overseas investors to invest in UK property through a non-UK company. For commercial property, this will generally remain the case.
For residential property, the introduction of UK CGT and Inheritance Tax for non-residents and the special rules for expensive homes mean this may no longer always be the case. We can help you choose the appropriate structure to maximise your exemptions.
